Leviner, Earnest Eugene  NCAL# 8126  (West End, NC)

Effective January 25, 2007, Mr. Leviner's auctioneer license was revoked for two violations of failing to maintain a trust or escrow account and deposit in the account all funds that are received for the benefit of another person as required by N.C.G.S. 85B-7.1(a); for two violations of failing to maintain, for not less than five years, complete records showing the deposit, maintenance, and withdrawal of trust or escrow funds and the disbursement of funds on auction day as required by N.C.G.S. 85B-7.1(b); for two violations of failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensees possession through an auction sale as required by N.C.G.S. 85B-8(a)(3); for one violation of commingling the funds or property of a client with the licensees own or failing to maintain and deposit in a trust or escrow account in an insured bank or savings and loan association located in North Carolina funds received for another person through sale at auction as required by N.C.G.S. 85B-8(a)(7); for one violation of the commission or conviction of a crime that is punishable as a felony offense under the laws of North Carolina or the laws of the jurisdiction where committed or convicted, or the commission of any act involving fraud or moral turpitude as referenced by N.C.G.S. 85B-8(a)(9); for two violations of failure to completely cooperate with any investigation as referenced by 21 NCAC 4B .0404(a)(6)(A); for two violations of making any false statement or giving any false information in connection with any investigation by the Board or the Boards designee as referenced by 21 NCAC 4B .0404(a)(6)(B); for one violation of committing a crime the circumstances of which substantially relate to the auctioneering profession as referenced by 21 NCAC 4B .0404(a)(8); for two violations of engaging in unprofessional conduct as referenced by 21 NCAC 4B .0404(a)(12); for one violation of obtaining or attempting to obtain compensation by fraud or deceit as referenced by 21 NCAC 4B .0404(a)(13); and for two violations of failure to possess truth, honesty and integrity sufficient to be entitled to the high regard and confidence of the public as referenced by 21 NCAC 4B .0404(a)(15).Earnest Eugene Leviner waived his right to appeal as allowed by law and agreed to the Board's findings of violations.


Levinsohn, Adam Saul  NCAL# 8975  (Chamblee, GA)

Effective February 14, 2011, Mr. Levinsohn voluntarily permanently surrendered his North Carolina auction license. This action resulted from Mr. Levinsohn's newspaper advertisements about "Bernie Madoff Auctions" which were believed to be false and misleading. This is a violation of G.S. 85B-8(a)(2) and (4); 21 NCAC 4B.0404(a)(6)(B); and 21 NCAC 4B.0604(a).


Loeser, Jr., Alan D.  NCAL# 7185  (Milford, CT)

Effective April 11, 2005, Alan D. Loeser, Jr.'s auctioneer license was revoked for one violation of making a false statement or giving any false information in connection with an application for renewal of a license; for five violations of failing to properly make disclosures required by 21 NCAC 4B .0405; for five violations of failing to report in writing to the Board any and all civil suits involving them that are based upon any allegation of gross negligence, dishonesty, fraud, misrepresentation or incompetency, or that in any way involve an auction sale or a transaction related to an auction matter or auctioneering; and for one violation of failing to notify the Board in writing of each change or addition of residence or business address within 10 days of the occurrence of such change. Alan D. Loeser, Jr. waived his right to appeal as allowed by law and agreed to the Board's findings of violations.


Loeser, Sr., Alan D.  NCAL# 7177  (Shrewsbury, PA)

Effective May 23, 2006, Alan D. Loeser, Sr.'s auctioneer license was revoked for giving false statements or false information on one or more applications for renewal of his auctioneer license as referenced by 21 NCAC 4B .0404(a)(6); for failing to completely cooperate with an investigation as referenced by 21 NCAC 4B .0404(a)(6)(A); for making one or more false statements or giving false information in connection with a Board's investigation as referenced by 21 NCAC 4B (a)(6)(B); for failing to properly disclose numerous civil actions filed against Auctions Worldwide or him as referenced by 21 NCAC 4B .0405(b) in violation of 21 NCAC 4B .0404(a)(16); and for failing to notify the Board of his change of address within ten days of the occurrence of the change as referenced by 21 NCAC 4B .0601(a) and (e). Mr. Loeser appealed the Notice of Probable Cause and an Administrative Hearing was subsequently conducted before the State Office of Administrative Hearings. Upon recommendation of the Administrative Law Judge, and following deliberation, the Licensing Board adopted the Proposal For Decision filed by the Administrative Law Judge and signed a Final Agency Decision.


Luttrell, Jeffrey Wayne  NCAL# 8984  (Salisbury, NC)

Effective January 25, 2011, Jeffrey Wayne Luttrell's auctioneer license was revoked for violation of G.S. 85B-8(a)(3) and (10) for failure to pay for items sold at auction and for not providing a final settlement statement. Mr. Luttrell waived his right to appeal as allowed by law and agreed to the Board`s findings of violations.
